Terms of Service


SYSTEM MONITORING

      Individuals using our system without authority, or in excess of their authority, are subject to having all of their activities on our system monitored and recorded by system personnel. UNAUTHORIZED access to our system will be tracked and logged. In the course of  monitoring individuals improperly using our system, or in the course of system maintenance, the activities of authorized users may also be monitored. 

   Anyone using this system expressly consents to such monitoring and is advised that if such monitoring reveals possible evidence of criminal activity, system personnel may provide the evidence of such monitoring to law enforcement officials. 

 

USER RULES AND RESPONSIBILITES

      No ISP or system has unlimited resources.  We ask that users be considerate of others on the system.    Swift-Networks can not  guarantee that any transmission or communication is truly confidential or private.  The provisions  of the Electronic Communications Act of 1986 apply in all cases. Swift-Networks will not release to individuals any information which you provided in your Account Application including name, address, phone number, username, except for the purpose for which is was provided unless required to do so by law or in case of emergency. Profanity and obscenity are prohibited on your home page.  The substitution  of **** in place of letters for profanity is not permissible. 

 

NET ABUSE

   Spamming
     Spamming is defined as mass cross-posting to Usenet newsgroups, or sending unwelcome, undesirable email to one or more users (not  necessarily on Swift-Networks' systems. 

   Flood and Clone bots
      A malicious connection(s) to an IRC Network with the intent to slow down, "flood off" or deny other users access to an IRC network. While consuming our bandwidth and resources, this activity denies legitimate users access to IRC networks and eventual banishment from the IRC  networks involved.  This activity will result in your account being removed immediately.

 
 

FILES STORED ON Swift-Networks

     The user should be informed that while Swift-Networks will make every attempt possible to ensure good uptime and that all files will be backed up and kept safe; it is the users responsibility to keep a copy of any files/programs on their local system, so that they can restore them, should a non-recoverable system failure occur.  Swift-Networks can not be held responsible for
data-loss.

 

SPAM POLICIES

      Swift-Networks does not authorize the use of its proprietary computers and computer networks to accept, transmit, or distribute unsolicited bulk e-mail sent from the internet.   User who do such will be billed a $500 network bandwidth fee, as well as various other storage fees, and will have their account terminated immediately.

 

ILLEGAL ACTIVITIES

      All illegal activity will result in the immediate termination of user privilege and possible criminal and civil prosecution.   The user specifically agrees to indemnify Swift-Networks for any losses, costs, or damages including reasonable attorney's fees incurred by Swift-Networks relating to or arising out of any breach of this section. Swift-Networks is not to be used for purposes contrary to Federal, Sate, or Local ordinances, regulations, or statues.  Obscene material, material of a threatening nature or liable to cause civil unrest, or material protected by trade secret are not permitted to be transmitted.  if a user is unsure as to the acceptability of material to be transmitted, please contact csr@Swift-Networks.net

   "Hacking"
   1. Knowingly accessing an Swift-Networks computer without authorization or exceeding authorized access. 
   2. Attempting to gain access to or modify any other user's account. 
   3. Interfering with or attempting to prohibit, restrict, or alter the normal operations of Swift-Networks or another On-Line Service. 
 

   "Trespass" 
   The use of another user's account without their permission is considered "trespassing" and, as such, an illegal activity. 

   The use of another users' e-mail name and/or password with the intent of assuming their identity is an illegal activity 

   Swift-Networks will fully co-operate with any Law Enforcement Agency (after receipt of a requisite subpoena) in the   investigation and persecution of any crime involving Swift-Networks' customers or its service. 

 

BILLING

     It is advisable to be familiar with Swift-Networks' billing rules in order to prevent billing disputes. The sooner a billing problem is brought to our attention, the easier it will be to resolve to everyone's satisfaction. We are unaware of a problem unless it is brought to our attention by either calling 1-866-SWIFT-96  or emailing to  billing@Swift-Networks.net.

     Age Limitation A customer must be a minimum of 18 years of age in order to subscribe to Swift-Networks . 

   Telephone Charges
     Swift-Networks will not be held responsible for any telephone charges including long distance, per-minute surcharges or equipment costs incurred by the user while connected to Swift-Networks services, or using other services provided by Swift-Networks. These charges are exclusively between the user and the telephone provider. 
 
    Rate Change
     Swift-Networks reserves the right to change monthly recurring fees, connection fees, equipment fees or to add new fees at any time with 30 days prior notice. If service has been prepaid, the new charges will not become effective until the expiration of the pre-payment. 

   Billing Disagreement
     Any disagreement or dispute concerning a bill must be made within 30 days of the billing date.  Charges disputed after this period of time will not be considered negotiable. 

   Immediate Notification Required
   A user must promptly notify Swift-Networks of any of the following changes to: 

                Home, Company or Billing Address. 
                Any suspected breaches of security, such as: Account or ID or password. 

   Termination of Service
     A customer cannot assume that their account automatically terminates when their payment remittances cease.
     Swift-Networks requires verbal or written notification of termination when canceling our service. 

   Introductory Offer 
     Swift-Networks reserves the right to offer introductory rates and specials limited to new customers only. If you have become an Swift-Networks customer within the previous 15 days, you are eligible for the introductory specials. 

   Bankruptcy
     Upon notice that a customer has filed bankruptcy, at its option, Swift-Networks may terminate service or require that customer pay 2 months advance on future service and a $25 administrative fee. 

   Returned-Check
     Swift-Networks will charge $20 for any returned check. 
     In the event of delinquency, the user agrees to pay a 15% collection fee plus court costs in addition to the amount owed. 

     PLEASE NOTE: Swift-Networks has established the 15th of the month as the late payment date.  Swift-Networks may impose and customer agrees to pay a late fee for all past due payments of 5%  per month, 18% annual. In the event that customer fails to pay Swift-Networks, all amounts due under this agreement and Swift-Networks refers this matter to an attorney, customer agrees to pay, in addition to the amount due, any and all costs incurred by Swift-Networks as a result to such action, including a reasonable attorney's fee. 



All users must agree to the Terms of Services listed above to use the services Swift-Networks provides.   Failure to comply with the above listed Terms of Service is grounds for immediate account suspension without refund.
